Security First Bank of North Dakota MyPic Studio Terms & Conditions
Security First Bank of North Dakota MyPic Studio Personalized Shazam Visa Check Card Service is subject to the following terms and conditions. Additional general terms and conditions apply to your Shazam Visa Check Card as outlined in account agreement.
The image submitted by you is herein referred to as the “Image”.
- You certify that you have read and understood the Image Guidelines and that the image you submitted to Security First Bank of North Dakota to be used on your Shazam Visa Check Card complies with the image guidelines.
- Unless waived as a part of a promotion or as a part of your deposit account type, your card-linked account will be debited for the fee of the Personalized Shazam Visa Check Card(s) ordered with the current fee schedule in effect at the time of the order. This applies to new, replacement or re-issued Personalized Shazam Visa Check Card(s).
- You warrant to Security First Bank of North Dakota that: (i) you are the owner of the Image (i.e. the image was taken by you) or you have obtained the express written consent from the Image’s owner to use the image on your Personalized Shazam Visa Check Card; (ii) you have obtained the express written consent from any person whose image you have submitted for use on your Personalized Shazam Visa Check Card; and (iii) use of the Image by Security First Bank of North Dakota will not infringe on any other person’s rights, including intellectual property rights in the Image.
- You grant, (or if you have obtained consent from the image’s owner, the image owner grants) to Security First Bank of North Dakota a perpetual, non-transferrable, non-exclusive, royalty free, world-wide, irrevocable license to use the Image and the data you provide to Security First Bank of North Dakota for the purpose of use with your Personalized Shazam Visa Check Card.
- You consent or you have obtained consent from the Image’s owner that Security First Bank of North Dakota has all rights to storing, modifying, copying or using the Image.
- You agree that you shall immediately indemnify, hold harmless and defend Security First Bank of North Dakota, its successors and assigns, from and against any and all claims and or losses arising from and/or suffered by Security First Bank of North Dakota resulting from your use of this service and/or as a result of the Image being used on and reproduced on your Personalized Shazam Visa Check Card, or arising out of or as a result of Security First Bank of North Dakota storing, modifying, copying or using the Image.
- Security First Bank of North Dakota ‘s liability hereunder is limited to refunding the fee associated with the issuance of the Personalized Shazam Visa Check Card, and Security First Bank of North Dakota is not liable to you for any loss, damage, claim or expense whatsoever in relation to any action by Security First Bank of North Dakota. Security First Bank of North Dakota is not responsible for poor quality images or images poorly positioned on the Personalized Shazam Visa Check Card.
- Your Personalized Shazam Visa Check Card remains property of Security First Bank of North Dakota and you agree to immediately return or destroy it if asked to by Security First Bank of North Dakota for any reason, or if the card or the accounts(s) that your Personalized Shazam Visa Check Card is linked to is closed.
- If approved, the Image will be stored by Security First Bank of North Dakota or its agents and contractors for a period of at least three (3) years. The Image will be printed on any subsequent reissued Personalized Shazam Visa Check Card(s) within a three (3) year period unless you have uploaded another image within that period.
- Security First Bank of North Dakota reserves the right not to accept or use any Image you submit and the right to refuse to issue a Personalized Shazam Visa Check Card for any reason it chooses at its sole discretion.
Image Guidelines
Our current Image upload guidelines restrict the use of certain types of images. The following guidelines have been put in place to help you with your selection; however, Security First Bank of North Dakota reserves the right to approve or deny any image for any reason whatsoever at its sole discretion.
Please do not submit images that contain the following:
- Copyrighted or trademarked material not owned by Security First Bank of North Dakota. If you didn’t take the photo or do not own the image, we cannot accept it.
- Branded Products
- Provocative, lewd, or sexual content – including nude or semi-nude pictures of people of any age.
- Celebrities, musicians, public figures, athletes, cartoons, etc.
- Violence, violent acts or any type of death imagery. (E.g. gangs, hatred, drugs, alcohol abuse, graffiti.
- Profanity or other obscene behavior or gestures.
- Images of money from any country (including the United States) where money is the central focus of the photo
- Images of flags.
- Controversial subject matter such as political or religious statements and/or images.
- Phone numbers (e.g. 800 or 900 numbers and URL addresses).
- Competitive, registered or otherwise protected service marks/names (e.g. Discover, American Express, etc.).
- Any images where the content is not clearly comprehensive or discernible. This includes non-English text, images, where the subject is unclear (i.e. blurry, distorted, etc.) and may be interpreted as violating the guidelines.
- Any reference to the Olympic Games or events.
- Any photo that might result in non-acceptance or other problems at the point of sale.
